IMPORTANT NOTICE

THIS AGREEMENT CONTAINS A BINDING ARBITRATION PROVISION AND CLASS ACTION WAIVER, REQUIRING YOU AND AIRIMMI TO RESOLVE DISPUTES BY INDIVIDUAL ARBITRATION AND WAIVING THE RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION, EXCEPT AS OTHERWISE STATED BELOW. PLEASE REVIEW SECTION 14 CAREFULLY.

These Terms of Use (this "Agreement") are between you and Elevatus Inc., doing business as Airimmi ("Airimmi," "we," "us," or "our"), and govern your access to and use of the website(s), portals, and online services we operate that link to this Agreement (collectively, the "Site") and the services provided by Airimmi (the "Services"). By accessing or using the Site or Services, you agree to be legally bound by this Agreement. If you do not agree to this Agreement, do not access or use the Site or Services.

Airimmi is an immigration services provider and is not a law firm; our Services do not constitute legal advice and do not create an attorney-client relationship. If you purchase Services that include independent attorney review, your relationship with the attorney will be governed by a separate engagement agreement with that attorney.

1. Description of Services; No Government Affiliation

Airimmi provides a platform designed to assist with the preparation and organization of certain immigration-related forms, supporting documents, and process guidance, as described on the Site. We provide information and tools intended to make the completion of such forms more efficient. Airimmi is not affiliated with, endorsed by, or a representative of United States Citizenship and Immigration Services (USCIS), the U.S. Department of State (USDOS), or any other government agency. All required government forms are available without cost from the applicable agencies, and use of the Site and Services is not required to complete or file such forms. Government rules, forms, and fees may change; where feasible, we endeavor to provide updates.

2. Not a Law Firm; Independent Attorney Notice

AIRIMMI IS NOT A LAW FIRM, DOES NOT PROVIDE LEGAL ADVICE, AND ITS SERVICES SHOULD NOT BE CONFUSED WITH LEGAL ADVICE. YOUR ACCESS TO OR USE OF THE SITE OR SERVICES DOES NOT CREATE AN ATTORNEY-CLIENT RELATIONSHIP WITH AIRIMMI.

If a Service includes review or assistance by an independent attorney, you will enter into a separate engagement agreement with that attorney, and any legal services will be governed solely by that agreement. The attorney will exercise independent professional judgment and is not controlled by Airimmi.

3. Eligibility

The Site and Services are intended for individuals 18 years of age or older. If under 18, do not use the Site or Services.

4. Accounts and Your Information

4.1 Account Creation. To access certain features, you must create an account and set a username and password. You agree to provide accurate, current, and complete information and to keep it updated. Do not impersonate any person or entity.

4.2 Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us promptly of any unauthorized use.

4.3 Communications. By creating an account, you consent to receive electronic communications from Airimmi and its affiliates, including offers, newsletters, account notices, and updates. You can opt out of marketing communications via the unsubscribe link in emails or by contacting us. Transactional or service-related communications may still be sent.

4.4 Application Status. Where applicable and permitted, you authorize Airimmi to use government-issued receipt numbers to check publicly available case updates in order to inform you about process steps and timelines.

5. Access to and Use of Site and Services

5.1 License to You. Subject to your compliance with this Agreement, Airimmi grants a limited, non-exclusive, non-transferable, revocable license to access and use the Site and Services as intended and authorized by Airimmi. All rights not expressly granted are reserved by Airimmi. You may not resell or distribute materials from the Site without Airimmi's prior written consent. Materials are for your personal, non-commercial use.

5.2 Prohibited Conduct. You agree not to:

  • Access data not intended for you or log into a server or account you are not authorized to access.
  • Use bots, scrapers, crawlers, or similar tools to access or search the Site, except standard third-party web browsers.
  • Interfere with Site operation, impose unreasonable load on our infrastructure, or introduce viruses, malware, or harmful code.
  • Probe, scan, or test the vulnerability of any Airimmi system or breach security/authentication measures.
  • Send unsolicited or unauthorized advertising, promotional materials, or spam.
  • Forge headers or otherwise manipulate identifiers to disguise the origin of content or communications.
  • Copy, modify, adapt, reverse engineer, decompile, disassemble, or create derivative works from Site software or content (except as permitted by applicable law).
  • Use any Site content, user content, or data as input into or to develop or train generative AI or machine learning models, except as expressly permitted by Airimmi in writing.
  • Violate any applicable law or third-party rights, or submit false, misleading, defamatory, or libelous material.
  • Knowingly withhold or fail to disclose information required for government forms where applicable.

Violations may result in civil or criminal liability. Airimmi may investigate and cooperate with law enforcement.

5.3 User Content License. If you submit or transmit content to or through the Site other than information solely to create your account or prepare applications and/or forms ("User Content"), you grant Airimmi a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media. Airimmi has no obligation to maintain, compensate for, or respond to User Content. You represent that you own or have the necessary rights to submit User Content and that Airimmi's use will not infringe third-party rights.

6. Fees and Payments

6.1 Service Fees and Government Fees. Some Services require payment of fees ("Service Fees") listed on the Site. Government agencies may charge separate filing and processing fees ("Government Fees"). Government Fees are separate from our Service Fees. Unless expressly stated otherwise in your purchase, you are responsible for paying Government Fees directly to the government.

6.2 Payment Authorization. When purchasing Services, you must provide valid payment information and authorize Airimmi to charge all due amounts. If we cannot process payment when due, we have no obligation to provide or continue Services.

6.3 Installments and Minimum Payments. If a payment plan is offered and selected, we may require a minimum number of payments before delivering certain materials or shipping any application package.

6.4 Refunds/Credits. Unless otherwise stated on the Site or in a service-specific guarantee, fees are deemed earned upon receipt because they cover access to our technology and service resources. Any refunds or credits outside stated guarantees are at Airimmi's discretion, in good faith.

6.5 Services with Attorney Review. If your Service includes independent attorney review, a portion of your Service Fees may be remitted to the attorney, as provided in the separate attorney engagement terms.

7. Ownership and Intellectual Property

All content and materials on or accessible through the Site and Services, other than User Content ("Airimmi Content"), are owned by Airimmi or its licensors and protected by intellectual property laws. Airimmi Content is for personal, non-commercial use only. No rights are transferred to you by this Agreement. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell, or exploit any Airimmi Content or related software, except as expressly permitted.

8. Copyright Policy (DMCA)

Airimmi respects intellectual property rights and will respond to proper notices of alleged copyright infringement by removing or disabling access to the material. To submit a notification or counter-notification under the Digital Millennium Copyright Act (DMCA), contact us at support@airimmi.com or by mail to: Elevatus Inc. (Airimmi), 254 Chapman Rd, Ste 208 #17973, Newark, Delaware 19702, United States. Your notice must include all required elements under 17 U.S.C. Section 512.

9. Third-Party Content, Services, and Links

The Site may reference or link to third-party services, sites, attorneys, or organizations for your convenience. Airimmi does not endorse or make warranties regarding any third parties or their services and is not responsible for third-party content or terms. If you access third-party sites or services, you do so at your own risk and may be subject to third-party terms and policies.

10. Privacy

Your use of the Site and Services is subject to our Privacy Policy, which explains how we collect, use, disclose, and protect personal information, and includes disclosures regarding our use of AI-enabled tools and third-party service providers.

11. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." AIRIMMI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AIRIMMI DOES NOT WARRANT THAT THE SITE OR SERVICES ARE ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THEY WILL MEET YOUR REQUIREMENTS. YOUR USE IS AT YOUR SOLE RISK. SOME JURISDICTIONS DO NOT ALLOW DISCLAIMERS OF CERTAIN WARRANTIES; SOME DISCLAIMERS MAY NOT APPLY TO YOU.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL AIRIMMI, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL AIRIMMI'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SITE OR SERVICES EXCEED THE TOTAL AMOUNT PAID BY YOU TO AIRIMMI FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; SOME LIMITATIONS MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless Airimmi, its affiliates, and their respective directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Site or Services; (b) your breach of this Agreement; (c) your violation of law or third-party rights; or (d) your User Content.

14. Dispute Resolution and Arbitration

Please read this section carefully. It affects your rights.

14.1 Informal Resolution. Most user concerns can be resolved quickly by contacting us at support@airimmi.com. We encourage you to contact us first to seek a resolution.

14.2 Binding Arbitration; Class Waiver. If we cannot resolve a dispute informally, you and Airimmi agree to resolve any claim, dispute, or controversy arising out of or relating to this Agreement, the Site, or the Services (collectively, "Disputes") through binding individual arbitration, or in small claims court where jurisdictional requirements are met. Arbitration will be administered by JAMS pursuant to its applicable rules, as modified by this Agreement, before a single, neutral arbitrator. You and Airimmi waive the right to a jury trial and to participate in a class action, class arbitration, or other representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to provide that relief.

14.3 Arbitration Procedures. If the parties do not agree otherwise, any arbitration hearing will take place in the county where you reside or another mutually agreed location; if your claim is for $10,000 or less, you may choose whether the arbitration is conducted via documents, telephonically, or in person. The arbitrator is bound by this Agreement. The Federal Arbitration Act (FAA) governs the interpretation and enforcement of this arbitration agreement.

14.4 Notice of Dispute. A party seeking arbitration must first send a written Notice of Dispute via certified mail to: Legal Department, Airimmi (Elevatus Inc.), 254 Chapman Rd, Ste 208 #17973, Newark, Delaware 19702. The Notice must describe the nature and basis of the claim and the relief sought. If the claim is not resolved within 30 days after the Notice is received, either party may commence arbitration.

14.5 Fees and Awards. The arbitrator may award any relief available in court on an individual basis. Each party will bear its own attorneys' fees and costs, unless the arbitrator awards fees and costs under applicable law.

14.6 Severability; Non-Applicability. If a court of competent jurisdiction determines that the class action waiver is unenforceable for a particular claim, then that claim (and only that claim) must proceed in court and be stayed pending arbitration of any remaining claims. This Section does not prevent bringing issues to federal, state, or local agencies, which may seek relief on your behalf.

15. Termination

This Agreement remains effective unless terminated as provided here. You may terminate by ceasing use of the Site/Services and, if applicable, closing your account by contacting support@airimmi.com. Airimmi may suspend or terminate your access at any time for any reason, including violation of this Agreement. Upon termination, your license to use the Site/Services ends immediately. Sections that by their nature should survive termination (including 5.2, 5.3, 7-14, and 16-17) survive.

16. Changes to this Agreement

We may update this Agreement from time to time. If we make material changes, we will provide notice (for example, by posting the updated terms on the Site and updating the "Last Updated" date, or by email if you have an account) before the changes become effective. Your continued use after the effective date constitutes acceptance of the updated Agreement.

17. Miscellaneous

17.1 Electronic Communications. You consent to receive communications from us electronically, and agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.

17.2 Assignment. You may not assign or transfer this Agreement (by operation of law or otherwise) without Airimmi's prior written consent. Any attempt to assign without consent is void. Airimmi may assign this Agreement without restriction.

17.3 Waiver. Any waiver of a breach must be in writing and will not be deemed a waiver of any other or subsequent breach.

17.4 Severability. If any provision is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17.5 Governing Law. This Agreement and any Dispute will be governed by the Federal Arbitration Act, applicable federal law, and the laws of the State of Delaware, without regard to conflicts of law principles, except that the arbitration provision is governed by the FAA.

17.6 Entire Agreement. This Agreement, together with any service-specific terms expressly referenced by Airimmi and our Privacy Policy, constitutes the entire agreement between you and Airimmi regarding the Site and Services and supersedes any prior or contemporaneous agreements on that subject.

This Privacy Policy explains how Airimmi ("Airimmi," "we," "us," or "our") collects, uses, discloses, and protects personal information. Airimmi is operated by Elevatus Inc., located at 254 Chapman Rd, Ste 208 #17973, Newark, Delaware 19702, United States. Airimmi is an immigration services provider and is not a law firm; our services do not constitute legal advice and do not create an attorney-client relationship. If a service includes review or assistance from an independent attorney, that attorney or law firm will enter into a separate engagement agreement with you (or a sponsor/employer), and any legal services are governed by that agreement.

This Policy applies to our websites, portals, applications, interactive features, and other online services that display or link to this Policy (the "Site" and "Services"). By using the Site or Services, you agree to this Policy. If you do not agree, please do not use the Site or Services.

1. Information We Collect

1.1 Identity and Contact Information.

  • Name, gender, date of birth, phone number, mailing address, email address, and similar identifiers.

1.2 Billing and Payment Information.

  • Payment card or bank account details processed by third-party payment processors. We do not store full sensitive payment data enabling direct account access; we may retain tokens, last four digits, and transaction metadata for reconciliation and support.

1.3 Immigration Application Information.

  • Materials and documents needed to prepare or file immigration forms and applications; government receipt numbers and notices.
  • May include sensitive data: national ID/SSN/passport number, immigration status, birth record details, race or ethnicity, religion, sexual orientation, disability status, employment and education history, and similar categories, depending on the service.

1.4 Usage Data.

  • Device/browser type, IP address, referrer URLs, timestamps, logs, pages viewed, clicks, and interactions with our Site and advertising.

1.5 Cookies and Similar Technologies.

  • Cookies, pixels, tags, web beacons, session replay scripts, and fingerprinting technologies used to recognize returning users, provide session functionality, personalize experiences, and perform analytics. You can manage or reject cookies in your browser settings; doing so may affect functionality.

1.6 Sources of Information.

  • You (directly), your employer/sponsor, your authorized representatives, publicly available sources, government agencies (for example, publicly accessible case updates), and service providers (for example, ID verification, analytics, support tools).

2. How We Use Personal Information

  • Provide and operate the Services: prepare and complete forms, submit applications where applicable, track and communicate application status, and provide customer and technical support.
  • Account creation and maintenance: register, verify, and manage accounts.
  • Personalization and improvements: tailor content and features; develop and improve our products and Services; conduct research and analytics (often in de-identified or aggregated form).
  • Security and integrity: prevent, detect, and investigate fraud, abuse, or security incidents; enforce terms; debug and ensure intended functionality.
  • Legal and compliance: comply with applicable laws, regulations, legal processes, and governmental requests.
  • Marketing communications: send permitted marketing about our or partners' services; you can opt out via unsubscribe links or by contacting us.

3. How We Share Personal Information

  • With your consent: for example, publishing testimonials or reviews.
  • Service providers: vendors supporting payment processing, cloud hosting, storage, IT/security, communications, customer support, analytics, advertising measurement, and related functions. They are bound to process data only under our instructions and to protect it.
  • Government entities and third parties for legal reasons: to comply with law, legal processes, or to protect rights, property, or safety.
  • Business transfers: in connection with mergers, acquisitions, reorganizations, financings, or asset sales; the acquiring entity must honor applicable privacy commitments.
  • Academic or research partners: only in de-identified and non-privileged aggregate form, for limited purposes.
  • Advertising and measurement partners: where allowed by law, for remarketing and cross-site measurement as described below and in Section 10.
  • We do not provide your personal information to third parties for their own direct marketing purposes without your consent.

4. AI Use and Third-Party Processing

To improve efficiency in form completion, document proofreading, preliminary material checks, fraud/risk screening, and customer support, we may use artificial intelligence and automation tools. Where necessary and lawful, vendors may access limited, task-minimized snippets of personal information for model inference, transcription, classification, summarization, or consistency checks. These vendors are contractually obligated to:

  • Process data only under our instructions and only for our business purposes;
  • Implement appropriate security and confidentiality safeguards; and
  • Not use your data for their own model training or marketing unless we obtain your consent or applicable law requires/allows otherwise.

We assess vendor processing locations and transfer mechanisms, minimize and/or de-identify data where feasible, and use encryption in transit and at rest where appropriate.

5. Children's Privacy

Our Site and Services are not directed to individuals under 18. We do not knowingly collect personal information from minors except as necessary to provide services to their parent or legal guardian. If you believe a minor provided personal information without appropriate consent, contact us so we can delete it.

6. International Data Transfers

We operate in the United States and may process personal information in the U.S. and other countries (which may include, for example, the Philippines) where we or our service providers are located. Those countries may have data protection laws different from those in your jurisdiction. Where required, we rely on appropriate safeguards (such as contractual clauses), necessity, or consent, and we implement reasonable protections for cross-border transfers.

7. Your Privacy Rights

Depending on your jurisdiction, you may have rights to access, correct, delete, restrict processing, object to processing, and obtain a portable copy of your personal information, and to withdraw consent where processing is based on consent (withdrawal does not affect prior processing). See "Contact Us and Requests" for how to exercise your rights.

8. Security

We use technical and organizational measures, such as encryption, access controls, network and application security, and audit logging, to protect personal information in transit and at rest. However, no method of transmission or storage is completely secure. To the extent permitted by law, we disclaim liability beyond mandatory legal obligations for losses caused by unlawful access or force majeure.

9. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with legal obligations, resolve disputes, protect our rights, and pursue legitimate business purposes. Unless you request earlier deletion, we may retain information for the maximum period permitted by law. In some cases, we may not be able to delete data immediately due to legal requirements or other legitimate reasons.

10. Disclosures Under State Privacy Laws

This section supplements other parts of this Policy and applies to residents of California and other Applicable U.S. States with similar privacy laws ("State Privacy Laws"). It also applies to individuals interacting with us in a business or commercial capacity.

10.1 Categories of Personal Information Collected, Disclosed, and Purposes (Past 12 Months).

In the preceding 12 months, we have collected and used the following categories of personal information for the purposes indicated and may have disclosed them to the recipient categories listed:

  • A. Identifiers (for example, real name, alias, IP address, email address, account name). Recipients: service providers; advertising and marketing partners; government entities. Purposes: internal processing; advertising/marketing.
  • B. California Customer Records (Cal. Civ. Code Section 1798.80(e)) (for example, name, postal address, telephone number). Recipients: service providers; government entities. Purposes: internal processing.
  • C. Protected classification characteristics (for example, age, race, disability, sexual orientation, religion, national origin). Recipients: service providers; government entities. Purposes: internal processing.
  • D. Commercial information (for example, records of products/services purchased, considered, or used on our Site). Recipients: service providers. Purposes: internal processing; advertising/marketing.
  • E. Internet or other electronic network activity (for example, browsing history, search history, interactions with our Site, applications, or ads). Recipients: service providers; advertising and marketing partners. Purposes: internal processing; advertising/marketing.
  • F. Geolocation data (approximate location inferred from internet information). Recipients: service providers. Purposes: internal processing; advertising/marketing.
  • G. Professional or employment-related information (for example, employer, job title, organization, area of responsibility, industry). Recipients: service providers; government entities. Purposes: internal processing; advertising/marketing.
  • H. Education information (non-public under FERPA) (for example, transcripts, diplomas). Recipients: service providers; government entities. Purposes: internal processing; advertising/marketing.
  • I. Sensitive personal information (for example, SSN; driver's license/state ID/passport number; racial or ethnic origin; religious or philosophical beliefs; immigration status; birth certificate information). Recipients: service providers; government entities. Purposes: internal processing.

We do not use or disclose categories C or I for any purpose other than to provide the Services you request or as otherwise permitted by law. We retain personal information for as long as necessary for the purposes described in this Policy.

10.2 Notice of Personal Information "Sales" or "Sharing."

Under the CCPA, "sale" is the disclosure of personal information for valuable consideration; "sharing" is disclosure for cross-context behavioral advertising. We do not knowingly sell personal information for monetary consideration. In the past 12 months, we may have "shared" the following categories for cross-context behavioral advertising:

  • A. Identifiers (for example, IP address, email address, account identifiers): recipients include advertising and marketing partners and service providers.
  • D. Commercial information (for example, product/service interest or usage on our Site): recipients include service providers.
  • E. Internet or other electronic network activity (for example, browsing and interactions with our Site or ads): recipients include advertising and marketing partners and service providers.

We use this information to display ads based on your activities over time and across nonaffiliated websites or apps. You may opt out of sharing by contacting us at privacy@airimmi.com and using our on-site mechanisms (including any "Do Not Sell or Share My Personal Information" link, if provided). We honor Global Privacy Control signals as described below.

10.3 Consumer Rights and Verifiable Requests.

Subject to legal limitations, residents of Applicable U.S. States may:

  • Request to know/access the categories and specific pieces of personal information we have collected, used, disclosed, sold, or shared;
  • Request deletion of personal information;
  • Request correction of personal information;
  • Obtain a portable copy of your personal information;
  • Opt out of the sale or sharing of personal information and limit the use/disclosure of sensitive personal information, where applicable; and
  • Be free from discrimination for exercising these rights.

Verification: The request must provide sufficient information for us to reasonably verify you are the consumer (or an authorized agent) and describe your request with sufficient detail to enable us to respond. We will use personal information in a request solely to verify identity/authority and to respond. Under the CCPA, you may submit up to two verifiable consumer requests in a 12-month period.

Appeals: If we deny your request, you may appeal by replying to our decision notice using the same contact method. If you remain dissatisfied, you may contact your state attorney general.

10.4 Opt-Out Preference Signals.

Some browsers allow you to send opt-out preference signals (for example, Global Privacy Control). We treat a valid Global Privacy Control signal as a request to opt out of sharing/sale for that browser or device. These signals may be browser/device-specific.
